Terms of Use and Terms and Conditions

Rules governing the use of the FASHIONPRAGUE TV platform and the purchase of memberships, tickets, goods and advertising services.

1. Operator and scope of these terms

The fashionprague.tv platform is operated by OLSO GROUP s.r.o., Company ID: 10875409, with its registered office at Politických vězňů 911/8 110 00 Praha 1, entered in the Commercial Register maintained by the Municipal Court in Prague, Section C, Insert 349991 (the “operator” or “FASHIONPRAGUE TV”). Contact: tv@fashionprague.tv or the platform contact form.

These terms govern use of the website, PWA application and related services, in particular live broadcasting, the video library, memberships, preregistration, community features, competitions, events, PRIVÉ digital profiles, the e-shop and advertising services. By submitting an order or creating an account, the user confirms that they have read the applicable terms.

2. User account and security

Users must provide accurate and current information, protect their password and not share their account with other people. A person must not create accounts to circumvent restrictions, blocks, competition rules or payment obligations. A user placing a paid order must be at least 18 years old or act with the consent of their legal representative.

The operator may require email verification and two-factor authentication for administration accounts. If misuse, a breach of the rules or a security incident is suspected, the operator may temporarily block the account for one or seven days or impose a permanent ban. The user may be informed of the reason and duration by email and notification.

A request to erase an account does not remove information that the operator must retain to meet accounting, tax, legal or security obligations. Erasing an account does not cancel outstanding liabilities or orders already placed.

3. Platform availability and scope of services

Content and features are made available according to the active membership package and assigned permissions. The selection of programmes, videos, live broadcasts, competitions and events may change over time. The operator may temporarily suspend the platform for maintenance, security or a technical fault and is not liable for outages caused by internet, hosting or payment-service providers or by force majeure.

Advertising formats may be displayed according to the membership level. Depending on the current offer, PRIVÉ may include viewing without preroll and midroll video advertising. The package description shown before the order is placed is decisive.

4. Membership, prices and orders

The current benefits of OPEN, CLUB, ICON and PRIVÉ, the price, billing period and any event benefits are shown on the membership page before the order is submitted. A user may have only one active membership package and one unpaid membership order at a time.

An order is created when it is submitted. The contract is concluded when the operator confirms the order. Membership is activated after payment is confirmed. Payment is made by a one-off bank transfer using the payment QR code or by card through Stripe when Stripe is enabled. With a QR/bank transfer payment, membership is activated after receipt and reconciliation of the payment. An unpaid order may be cancelled automatically after the stated deadline.

Before submitting a binding order, the user expressly requests that the digital membership and the available digital content and benefits be supplied immediately after payment is confirmed, before the end of the 14-day withdrawal period. The user also acknowledges that, once digital content or the service is made available, the right of withdrawal may be lost to the extent permitted by law. The consent and its timestamp are recorded with the order and confirmed by email.

5. Renewal, upgrade, downgrade and cancellation

A card payment may establish an automatically renewing subscription. The user can disable automatic renewal in their account before the next renewal. Bank transfer and QR payments are one-off and do not repeat automatically.

Voluntarily cancelling an annual or monthly membership disables the next renewal; it does not refund the price of the current paid period. The membership, its status and benefits remain active until the last day of the period already paid. The account then moves to OPEN unless the user selects another membership. This does not affect statutory consumer rights, in particular rights arising from defective performance.

When moving to a higher package, an order is created only for the proportional price difference until the end of the current period, and the higher package is activated after payment is confirmed. A move to a lower package takes effect from the next billing period; the original package remains active until then.

6. Preregistration and founding membership

Preregistration is an order for a paid membership before the platform’s official launch. After payment is confirmed, the user immediately receives a preregistration profile, confirmed membership status, available digital features and the announced preregistration benefits. Delivery of this part of the service therefore begins upon payment.

The paid monthly or annual period begins only on the launch date shown on the preregistration page and in the order. The period between payment confirmation and launch is provided at no additional charge. ICON and PRIVÉ event benefits are personal, non-transferable, subject to capacity and the rules of the relevant event, and cannot be exchanged for cash unless expressly stated otherwise.

Disabling the next renewal during preregistration does not refund the price of the period already purchased; membership continues until the date stated in the order. Statutory consumer rights remain unaffected.

7. Events and tickets

A ticket order states the event name, date, venue, number of tickets, price and payment method. After payment, the system issues a payment document and a valid ticket with a unique QR code. The user must not copy, sell or disclose the QR code to third parties without authorisation.

For leisure activities taking place on a specified date, the consumer may not have a 14-day right of withdrawal. Cancellation, transfer and refund options are governed by the rules of the particular event and by law. If the operator cancels an event, the user will be informed about a replacement date or a refund. Admission may be refused to a person who breaches the event’s safety or operational rules.

8. E-shop, delivery and returns

The principal characteristics, price, availability and collection or delivery method are shown before goods are ordered. An order is initially issued for payment. Once payment is confirmed, a payment document is created and the order is processed for delivery or personal collection. An unpaid order may be cancelled automatically when it becomes overdue.

A consumer may withdraw from a distance purchase of goods within 14 days of receipt unless a statutory exception applies. Goods must be returned complete, undamaged and with accessories; the original packaging is recommended but is not, in itself, a condition for exercising the statutory right. The consumer is responsible for any reduction in value caused by handling beyond what is necessary to establish the nature and characteristics of the goods. Once a return is approved, the payment is refunded and a corresponding credit note is issued.

9. Advertising campaigns and partnerships

The advertising partner is responsible for accurate billing information, authorisation to use supplied photographs, videos, logos, trade marks and destination links, and compliance of the advertisement with applicable law. The order specifies the format, placement, period and final campaign price.

A campaign is subject to the operator’s approval. Materials that are misleading, unlawful, technically unsuitable, infringe third-party rights or conflict with the platform’s focus may be returned for revision or rejected. An unpaid rejected campaign is cancelled; a paid rejected campaign is handled according to the order status and the appropriate refund and credit note are issued.

Impression and click counts are statistical figures, not a guarantee of a commercial result. Unless expressly agreed otherwise in the order, the campaign price is fixed for the selected period regardless of the number of impressions and clicks.

Product placement and programme sponsorship are agreed individually. Their scope, price, date, identification as commercial communication, any exclusivity and approved brand use must be confirmed in a separate order or agreement. A partner must not influence content in a way that compromises the editorial responsibility and independence of FASHIONPRAGUE TV. Product placement and sponsor identification must not mislead viewers or directly encourage a purchase in an unreasonable manner.

10. User content, community and PRIVÉ profiles

Users are responsible for text, comments, videos, photographs, links, profile information and any other content they upload. They warrant that they hold all necessary rights and consents and that the content does not infringe copyright, trade marks, privacy or image rights.

By uploading content, the user grants the operator a non-exclusive, royalty-free licence to the extent necessary to store, technically process, display and promote the content within the platform. The user retains ownership and copyright. The operator may hide or remove content that breaches these terms, the law, third-party rights or platform security.

Prohibited content and conduct include unlawful content, pornography, sexual services, incitement to violence, hate speech, bullying, threats, fraudulent or misleading information, spam, malware, unauthorised collection of personal data, circumvention of security and harm to the platform or its users. Competitions are governed by the rules of the particular competition and the eligibility of the membership package.

A PRIVÉ digital profile is a member’s professional presentation. Its contact form must not be used for spam or harassment. The operator does not guarantee that cooperation will be concluded or that every third-party offer is accurate; suspicious conduct should be reported.

A PRIVÉ member may publish up to three professional news items on their profile per calendar month. Deleting a published item does not restore that monthly allowance. News items are intended for presenting the member’s own work, projects and professional announcements. Paid, undisclosed or other advertising for third parties, brands, products or services is prohibited without the operator’s prior written consent. Non-compliant content may be hidden or removed without notice and the account may be blocked for one day, seven days or permanently, depending on the seriousness of the breach.

11. Intellectual property, brand and external links

The FASHIONPRAGUE TV designation, graphics, programmes, videos, text, photographs, databases, software and other proprietary materials are protected. They must not be systematically copied, downloaded, republished, framed, scraped or commercially exploited without prior consent. Ordinary sharing of a link to a public page is permitted provided it is not misleading and does not damage the brand.

The platform may contain links to third-party websites. The operator does not control their content, availability or security, and opening them is the user’s decision.

12. Claims, withdrawal and refunds

A claim, statutory withdrawal or other request may be submitted through the contact form or by emailing the operator. The user should provide the order number, a description of the issue and contact details. Claims will be handled within the statutory time limit.

Before paying for digital membership, the user is informed that delivery begins immediately and gives express consent through an active step. If the statutory requirements for losing the right of withdrawal are not met, the consumer’s right remains in force. Nothing in these terms excludes rights that cannot be contractually restricted under Czech law.

A refund is always linked to the original paid document and confirmed by a credit note. Voluntarily disabling automatic membership renewal is not a refund.

13. Liability and technical security

The operator does not exclude or limit liability where doing so would be unlawful. However, the operator is not liable for loss caused by misuse of a user’s credentials, inaccurate user content, an incompatible device, a third-party outage or an event beyond its reasonable control.

Users must not introduce viruses or malicious code, attack service availability, obtain unauthorised access or extract data by automated means. Such conduct may result in immediate blocking and notification of the relevant authorities.

14. Changes to the terms and termination of services

The operator may reasonably amend these terms due to changes in law, features, prices, security or the business model. Material changes will be announced by an appropriate method before taking effect. A period already paid remains governed by the terms in force when the order was placed unless the law or an agreement provides otherwise.

If the operator discontinues a paid service without a breach by the user, the undelivered proportion of the paid period will be settled proportionately. Rights arising from termination or blocking for a serious breach are assessed under the law and the circumstances of the case.

15. Governing law and alternative dispute resolution

Legal relationships are governed by the laws of the Czech Republic. This does not deprive a consumer of protection afforded by mandatory provisions of the law of their habitual residence.

If a consumer dispute cannot be resolved by agreement, the consumer may apply for alternative dispute resolution to the Czech Trade Inspection Authority, Central Inspectorate — ADR Department, Gorazdova 1969/24, 120 00 Prague 2, email adr@coi.gov.cz, website coi.gov.cz/en/information-about-adr.
